Can a Mother File a Traumatic Birth Lawsuit?

As a mother, you should be aware that you can file a medical malpractice lawsuit in relation to a botched delivery, even if your child was not injured during the birthing process. Sadly, it is not uncommon for mothers to be injured during labor because of the negligence of a medical provider. These injuries can include bone and joint injuries, organ injuries and injuries to the vaginal area. For example, in 2014, an Iowa woman was awarded damages after she sustained the stretching and tearing of muscles, ligaments, tendons and cartilage of her hip and upper leg following a botched birth. A jury found her healthcare providers at fault for not attending to her properly.
