According to the Madison St. Clair Record, Jennifer and Lance Schenider filed a lawsuit against Protestant Memorial Medical Center doing business as Memorial Hospital and Dr. Michael E. Herrmann. The parents allege their daughter, Sophia Schenider, suffered a brain injury during the birth process and action of both hospital and doctor caused her cerebral palsy.

The Scheniders claim their daughter was born with hypoxic brain injury, which is when the brain does not receive enough oxygen during the birthing process. Because of her brain injury, Sophia developed cerebral palsy. Sophia lost enjoyment of a normal life and sustains disfigurement, disability, pain and suffering, according to the complaint.

Sophia Schenider has no ability to become adequately educated, has suffered impaired earning capacity, and will continue to incur large medical costs, the lawsuit states.

Her parents allege the hospital and Dr. Hermann caused Sophia’s injuries by negligently rupturing membranes when her head engaged before birth and failed to utilize in-utero resuscitation maneuvers. The parents also claim the doctor failed to prepare for an emergency C-section to prevent prolonged deceleration. The family of Sophia Schenider seeks more than $150,000 in court judgment plus costs.
