Fort Hood Family Sues Government Over Son’s Birth Injuries

According to the Killeen Daily Herald, the parents of a child born with severe birth injuries at a military hospital at Fort Hood have settled their lawsuit against the U.S. government for $6.5 million.

The paper reported that Kassie and Higinio Rivera filed a lawsuit against Darnall Army Medical Center in U.S. District Court for the Western District of Texas, located in Austin, following the birth of their son on September 12, 2008.

The lawsuit alleged that doctors at the hospital ignored evidence that Kassie’s contractions were over stimulated due to the excessive use of “oxytocin causing severe distress in the baby and the need for immediate delivery by caesarean section.”

Following his birth, Haiden was diagnosed with severe brain injuries and cerebral palsy. He had to be airlifted to a hospital at Lackland Air Force Base in San Antonio and remained hospitalized for about eight days.

Haiden is now nonverbal and must be fed through a feeding tube. “Life is different for him, but for the most part, he’s happy,” Kassie said, according to the Killeen Daily Herald.
