According to KPTV-TV, three Oregon families are filing separate multi-million dollar lawsuits against a hospital after their children were born with brain damage and cerebral palsy. image-hand

The families are reportedly suing the Silverton Hospital, located in Marion County.

One of the families involved in the lawsuit claims that their child was born with permanent brain damage and cerebral palsy because of mistakes made in the delivery room at the hospital. The family claims that doctors failed to recognize and respond to the labor process, and failed to deliver the baby via a C-Section in a reasonable period of time.

Another family claims that their child was born “lifeless”, but the hospital did not take adequate steps in an attempt to bring the child back to life, depriving him of oxygen for 14 minutes, which resulted in him suffering a catastrophic brain injury, which will require lifelong care.

The other family reported similar issues during the birthing process, where its child was not delivered via C-Section in a timely manner and suffered brain injuries as a result.

Each family suing is seeking about $40 million in damages. One of the cases is expected to go to trial in early 2015. The hospital would not comment on the lawsuits.

Can I Sue My Healthcare Provider If My Child Was Injured During Birth?

Recently, there have been a number of high-profile cerebral palsy lawsuits in the news. Earlier this year, a Pennsylvania family was awarded $55 million after its baby boy was not getting enough oxygen during birth and should have been delivered via Caesarean section. The boy suffers from cerebral palsy now as a result.

Birth injuries resulting from the failure to order a C-section in a timely manner include deformities, brain damage, cerebral palsy and erb’s palsy, all of which require expensive and extensive physical therapy and rehabilitation.

In addition, brain injuries or issues like cerebral palsy can cause intellectual limitations, hearing deficits, vision impairment, behavioral problems, seizures, speaking difficulties and learning disabilities, which require specialized education needs.
