Family Sues Fed Over Child’s Brain Injury

A teenager has been awarded more than $15 million after suffering a brain injury during his birth at the Blanchfield Army Community Hospital at Fort Campbell, Ky. The now 15-year-old suffers from neurological deficits resulting from cerebral palsy, according to his lawsuit, which was filed against the federal government. His family claims that his mother originally suffered from placental insufficiency during the birthing process of her first child, meaning her placenta failed to deliver enough oxygen to the child, resulting in a Caesarean section. However, the family claims that during the injured child’s birth, doctors failed to review the mother’s medical history, which would have indicated she may have needed to undergo another C-Section to deliver the child. Washington Family Awarded $24 Million for Child’s Brain Injuries

A Washington jury recently awarded a family $23.9 million in damages after it claimed that a child suffered permanent brain injuries due to suffocation during her birth. According to the Port Hadlock Leader, a Kitsap County jury determined that Jefferson County Public Hospital District was negligent in handling the child’s birth, resulting in injuries. Jefferson Healthcare said it would appeal the verdict, which was handed down in December. Lawyers for the family argued that providers with the hospital missed several critical signs during the birthing process in 2014, including that her umbilical cord wrapped around her neck, cutting off her supply to oxygen. The attorneys argued that the healthcare providers used a fetal heart monitor during the delivery, but negligently picked up the mother’s heartbeat instead of the baby’s. Ohio Couple Awarded $11.35 Million for Child’s Brain Injury

An Ohio jury recently awarded a couple an $11.35 million verdict in an alarming birth injury lawsuit involving a boy with brain damage. According to Ohio.com, the verdict was announced in February in Summit County, in a medical malpractice case involving a local OB/GYN and hospital. The family involved in the lawsuit said the boy is expected to need specialized medical care for the rest of his life. The boy was born in 2001 and the family contented in its lawsuit that there were several signs the child may need to be delivered via C-Section. However, the doctor involved in the delivery allegedly opted to deliver the child vaginally, using a vacuum and forceps.
