According to Seedol, a Wisconsin woman was awarded a birth trauma settlement of $18.2 million after a jury found the former Sinai-Samaritan Hospital in Milwaukee negligent in the brain injury lawsuit. The plaintiff alleged that she received horrific care from the federally funded hospital that led her daughter to suffer permanent and severe brain damage.

The plaintiff claimed she went to the former Sinai-Samaritan Hospital for the delivery of her daughter, and that the hospital staff failed to address her risk of complications , and that she was not referred to a specialist despite the fact that she had been diagnosed with gestational diabetes and had a documented history of previously delivering above average weight babies. Instead, the plaintiff received care by a family practice doctor as well as midwives. According to her birth injury lawsuit, had her pre-registration notes been carefully read, the staff would have provided her the proper medical attention that she needed and avoided the birth injury her daughter sustained.

To add to horrific care endured at the hospital, the staff left the pregnant mother unattended for duration of over 12 hours even though she was already dilated. During the birthing process, the baby became lodged for over 20 minutes in the birth canal and suffered traumatic birth injuries as a result of lack of oxygen to her brain. The child suffered birth injury caused by a tremendous amount of pressure and stress placed upon the baby while passing through the birth canal. A common factor that causes such birth trauma is prolonged labor. The jury awarded $18.2 million to the plaintiff to aid in future medical costs that will be incurred to treat the now 10-year-old daughter.
