Did you know that delays during delivery could result in a baby experiencing brain damage and/or cerebral palsy? Recently, a Florida jury awarded $8.4 million to the family of a boy who was diagnosed with cerebral palsy following birth complications. According to the Gainesville Times, a jury ruled that Northeast Georgia Medical Center was negligent in its handling of the boy who was injured in 2008. The paper reported that the boy, now 5, suffered from a delayed delivery, which required immediate resuscitation. However, a tube was not inserted into the boy’s mouth to revive him until eight minutes after he was born. The boy now uses a wheelchair and is unable to walk or talk. As we have reported in our blog previously, the failure of a healthcare provider to respond reasonably and accurately to situations that may arise during the birth of your child can have devastating consequences.  Many birth injuries, including cerebral palsy, erb’s palsy and brain damage, are the result of doctor errors and/or issues with delays. It should be noted that issues like a delay in ordering a caesarian (C-) section or a physician erroneously using forceps or a vacuum extractor can result in a child suffering injuries that can haunt him or her for life. Sadly, this is not uncommon. Recently, a Maryland appeals court upheld a $20.6 million verdict for a family whose son was born with cerebral palsy.
