Texas Family Plans to File Lawsuit After Forceps Allegedly Crush Daughter’s Skull

According to the New York Daily News, a five-day-old baby from Texas died after her skull and spine were allegedly cracked by forceps during her delivery. The baby, Olivia Marie, died after her doctor, George T. Backardjiev, of the Medical Center of Southeast Texas, reportedly refused to perform a cesarean section (C-section) on December 28, 2013. Olivia’s mother, Rachel Melancon, reportedly asked the doctor about performing the procedure prior to the baby’s delivery because of her small size. Rachel is reportedly 4’11”, and had fears that her small frame might complicate a natural birthing process. Backardjiev reportedly told family members that the C-section procedure would leave a scar on her body and cautioned against it. During labor, which lasted 18 hours, Olivia’s heart rate reportedly increased, but her mother was still told to wait before a procedure could take place. Fort Hood Family Sues Government Over Son’s Birth Injuries

According to the Killeen Daily Herald, the parents of a child born with severe birth injuries at a military hospital at Fort Hood have settled their lawsuit against the U.S. government for $6.5 million. The paper reported that Kassie and Higinio Rivera filed a lawsuit against Darnall Army Medical Center in U.S. District Court for the Western District of Texas, located in Austin, following the birth of their son on September 12, 2008. The lawsuit alleged that doctors at the hospital ignored evidence that Kassie’s contractions were over stimulated due to the excessive use of “oxytocin causing severe distress in the baby and the need for immediate delivery by caesarean section.” Following his birth, Haiden was diagnosed with severe brain injuries and cerebral palsy. Family Sues United States After Baby Suffers Brain Injuries

According to Courthouse News Service, a federal judge has ordered the United States to pay more than $28 million to the family of a boy who suffered severe brain injuries when doctors failed to performed a timely Caesarean section (c-section). The news outlet reported that U.S. District Judge David R. Herndon entered judgment on December 20 for Sean Cobbs and his parents Patoya Bryant and Sean Cobbs Sr. The case took place in East St. Louis, Illinois. According to Courthouse News Service, the judgment “includes $3,216,827 for lost earnings, $15,165,708 for future care, $231,713 for past medical expenses, $5 million for loss of normal life, $3 million for pain and suffering, $2 million for disfigurement, $1 million for risk of future harm and a setoff of $1.6 million from a settlement with Southern Illinois Hospital Services.” The family reportedly sued the United States under the Federal Tort Claims Act, citing…
