Family Sues Fed Over Child’s Brain Injury

A teenager has been awarded more than $15 million after suffering a brain injury during his birth at the Blanchfield Army Community Hospital at Fort Campbell, Ky. Birth Trauma

The now 15-year-old suffers from neurological deficits resulting from cerebral palsy, according to his lawsuit, which was filed against the federal government.

His family claims that his mother originally suffered from placental insufficiency during the birthing process of her first child, meaning her placenta failed to deliver enough oxygen to the child, resulting in a Caesarean section.

However, the family claims that during the injured child’s birth, doctors failed to review the mother’s medical history, which would have indicated she may have needed to undergo another C-Section to deliver the child.

The family lawyers claim that had this been done, the child would not have suffered brain injuries. They allege that the mother was also given standard VBAC (vaginal birth after caesarean) counseling and a consent form to sign, but she was not provided with high-risk consultation, as was the hospital policy.

According to TheLeafChronicle.com, the child suffered a hypoxic-ischemic brain injury during his birth, which will leave him needing constant medical care for life.

The family was awarded $15.1 million in damages in future medical care, lost earnings, suffering, past loss of enjoyment of life and permanent impairment, according to the website.

Brain Injuries During Birth Can Have Long-Term Consequences

As this story allegedly shows, brain injuries brought on by alleged malpractice present significant obstacles to both the individual living with the disability and his or her loved ones. Parents are often forced to pay for medical treatment and therapies for the remainder of a malpractice victim’s life, which is why lawsuit verdicts are often substantial.
