Illinois Family Awarded $23.6 Million for Child’s Brain Injury

An Illinois jury recently awarded a girl $23.6 million after she sustained severe brain injuries during her allegedly botched delivery. Birth Trauma

According to the Chicago Tribune, the Cook County birth injury lawsuit involved Amita Health Saint Joseph Hospital Chicago. Last month, jurors awarded the girl, now 4, compensation for her pain and suffering, as well as her future medical expenses.

The newspaper reported that in 2014, the girl’s mother went to the hospital when she was pregnant for testing and observation following a fall earlier in the day. However, doctors reportedly sent her home and decided on testing later at later dates.

Following the event, a few weeks later she returned to the hospital for testing after she was kicked at work (the mother worked as a nursing assistant and a patient allegedly got physical with her). During testing, it was discovered that there were issues with the child’s heartbeat, and the child was delivered about three hours later via caesarian section (C-Section).

Attorneys for the family said there was an “unreasonable delay” from testing to getting the baby delivered. They said that during the three hour period, the child suffered from hypoxic ischemic encephalopathy and that she did not receive enough blood or oxygen for a period of time.
