New Mexico Family Awarded $73.2 Million for Botched Child Delivery

A family in New Mexico was awarded $73.2 million earlier this month after a doctor allegedly botched a child birth leaving a baby with permanent brain damage. Birth Trauma

The child reportedly sustained several injuries that will require long-term care. According to the lawsuit, which was filed in Santa Fe, a Carlsbad doctor and healthcare clinic were negligent in caring for and monitoring a potentially risk delivery, which led to the injuries.

The doctor involved in the lawsuit allegedly died prior to the trial. The child’s birth occurred in 2013, with attorneys alleging he was quite large, weighing 11.5 pounds.

The mother is diabetic and attorneys say the doctor involved in the lawsuit failed to properly examine her over the course of more than a dozen visits to a patient clinic prior to birth. The mother was allegedly at-risk for delivering a large baby because of her age, 36, and her diabetic state.

The mother claimed in her lawsuit that several tests done prior to birth were performed incorrectly, estimating the child’s weight at 8 pounds. During his delivery, the large child was too wide to pass through the mother’s birth canal and he became logged inside her without access to oxygen until he was finally pulled out via vacuum.

Lawyers claim that when he was pulled out, he also suffered permanent injuries to his right arm, to go along with brain damage. It is thought that he will need to live in a group home as an adult due to his injuries. He reportedly has no use of his right hand and limited arm mobility, as well as impaired cognitive capabilities.

The doctor could have allegedly performed a C-Section had the child been properly monitored prior to birth, according to attorneys. Had this been done, the child may not have suffered the injuries. For further information, you can click on the link below.

Birth Injuries Can Lead to a Lifetime of Medical Costs

This story is a sad reminder that mistakes by medical providers can lead severe injuries for babies. Instances of brain damage during birth can occur due to complications with delayed medical care, as well as the use of forceps or vacuums being used too strongly on a child’s skull. Additionally, complications during surgical procedures can result in major brain trauma.
