Family Receives $4M Settlement in Birth Trauma Lawsuit

A family in Rhode Island received a $4 million settlement from a hospital that they claim made decisions immediately after the birth of their child that led to his permanent brain damage. According to the birth trauma lawsuit, the birth was normal. The child did not respond to breastfeeding, so the doctor asked nurses to feed the child formula. They did not adhere exactly to the doctor’s orders, and the baby suffered a hypoglycemic episode. The parents say the episode caused brain damage that lead to continuing problems with vision, tactile sensory disorders and developmental issues. The child is now seven years old and still experiences these issues. By ignoring warning signs and risk factors of hypoglycemia such as low birth weight and poor response to breastfeeding, the parents say the hospital is responsible for their child’s current difficulties. Parents File $50 Million Birth Injury Suit Against Hospital

Each moment counts when delivering a baby, especially when things start to go wrong. A recent federal tort lawsuit filed in California alleges that one hospital’s mistake caused $50 million worth of permanent brain damage to a child. When Stefanie Davis went into labor in January of 2010, doctors determined that a vaginal birth was out of the question due to the baby’s position. The attending physician performed a C-section with a vacuum extraction, which many health experts acknowledge poses certain health risks to the baby. The procedure involves placing a small vacuum on the baby’s head to aid its removal from the womb. After removing the baby, nurses noticed signs of distress on the child where the doctor applied the vacuum, such as bruising, swelling and hemorrhaging. How Jaundice Led to Cerebral Palsy

Earlier this week we wrote about “The House of Gort,” a 16-minute documentary that features a family with special needs children. All three children were born with jaundice due to their parents’ incompatible blood type, and medical errors caused one daughter to develop cerebral palsy. What is Jaundice? Jaundice occurs when the body fails to expel bilirubin, a waste chemical produced by a reaction inside the liver. It is very common in newborns; the Children’s Liver Disease Foundation says that 90 percent of newborns experience some degree of jaundice in the first few days following birth. Jaundice occurs because the baby must start using its liver for the first time. Until birth, the placenta does the liver’s job. Jaundice Treatments Doctors commonly use a light treatment called phototherapy to balance out the bilirubin. Most babies respond positively to the treatment.
