Can a Mother File a Traumatic Birth Lawsuit?

As a mother, you should be aware that you can file a medical malpractice lawsuit in relation to a botched delivery, even if your child was not injured during the birthing process. Sadly, it is not uncommon for mothers to be injured during labor because of the negligence of a medical provider. Image of baby hand

These injuries can include bone and joint injuries, organ injuries and injuries to the vaginal area. For example, in 2014, an Iowa woman was awarded damages after she sustained the stretching and tearing of muscles, ligaments, tendons and cartilage of her hip and upper leg following a botched birth. A jury found her healthcare providers at fault for not attending to her properly.

Birth trauma can result in injuries that can leave a mother permanently disabled, causing complications while raising a child. No mother should have to suffer due to careless medical errors that can include the failure to order a timely caesarean section or the failure of a doctor to properly monitor physical conditions.

Alabama Woman Awarded $16 Million for Traumatic Birth

According to Yahoo! News, an Alabama woman was awarded $16 million in damages earlier this year after she suffered injuries during her child’s birth.

The news outlet reported that Caroline Malatesta, of Birmingham, was halfway through her fourth pregnancy when she decided to use a birthing approach marketed as “autonomy” by her provider Brookwood Medical Center. The approach was supposed to provide her with access to private birthing tubs and nicer suites.

However, during the birth she was forced on her back for six minutes as her son’s head was crowning inside of her. The mother suffered a severe nerve injury during the birth, pudendal neuralgia, which causes her lingering pain.

In her lawsuit, the mother claimed that she now has to consistently take pain medication and has to fight off panic attacks, and that her sex life has suffered, causing her to seek therapy. She said it turned her family life “upside down.” She claimed the hospital used a “bait-and-switch” approach to maternity care, marketing services one way, while providing inadequate care, according to Yahoo!
