Mass. Family Awarded $30 Million for Child’s Brain Injury

A Massachusetts family was recently awarded $30 million after a child was born with significant brain injuries. According to the Boston Globe, the family filed a lawsuit against a nursing staffing agency, saying the provider failed to properly monitor the birth of the child during his delivery. The mother involved in the lawsuit was allegedly in labor and pushing for more than five hours, and her son was born with almost no heartbeat and was not breathing. The lawsuit claims that the medical team was not using a continuous fetal heart-rate monitor during the delivery. As a result, the family said the child suffered severe brain injuries, as an umbilical cord was wrapped around his neck during the delivery. The delivery occurred in 2013. Illinois Family Awarded $23.6 Million for Child’s Brain Injury

An Illinois jury recently awarded a girl $23.6 million after she sustained severe brain injuries during her allegedly botched delivery. According to the Chicago Tribune, the Cook County birth injury lawsuit involved Amita Health Saint Joseph Hospital Chicago. Last month, jurors awarded the girl, now 4, compensation for her pain and suffering, as well as her future medical expenses. The newspaper reported that in 2014, the girl’s mother went to the hospital when she was pregnant for testing and observation following a fall earlier in the day. However, doctors reportedly sent her home and decided on testing later at later dates. NJ Family Awarded $20 Million in Birth Injury Case

According to Law.com, a Union County, New Jersey jury recently awarded a family $20 million in damages after a child suffered brain injuries prior to her birth. A jury found that two doctors failed to promptly treat the woman despite the fact that she was showing fetal distress prior to the child’s birth. The child, born in 2011, now has cerebral palsy. In the lawsuit, the family claimed that a technician discovered that the girl developed intrauterine growth retardation during an ultrasound check at the 33rd week of pregnancy. However, a report sat in the maternal fetal medicine medical office for four days detailing the retardation before it was faxed to the mother’s obstetrician. The retardation caused the child to lose weight because it was not getting proper nutrition.
