Ohio Couple Awarded $11.35 Million for Child’s Brain Injury

An Ohio jury recently awarded a couple an $11.35 million verdict in an alarming birth injury lawsuit involving a boy with brain damage. Birth Trauma

According to Ohio.com, the verdict was announced in February in Summit County, in a medical malpractice case involving a local OB/GYN and hospital. The family involved in the lawsuit said the boy is expected to need specialized medical care for the rest of his life.

The boy was born in 2001 and the family contented in its lawsuit that there were several signs the child may need to be delivered via C-Section. However, the doctor involved in the delivery allegedly opted to deliver the child vaginally, using a vacuum and forceps.

The child allegedly had a large head, which was not facing the right direction for a safe delivery. The family alleged that the child suffered multiple contusions and bruising during the delivery.

The parents alleged that the child was hospitalized in neonatal intensive care following the delivery, although he appeared to be normal functioning when he was brought home. However, after several years, his parents began to notice social and developmental delays.

An MRI eventually discovered that the boy suffered brain damage. His parents concluded that this brain injury was suffered during his complicated birth.

Jurors agreed with the parents, awarding damages for a poor communication with the mother during the delivery and poor medical charting during the delivery that resulting in a missed opportunity for a C-Section.
