Irish Family Compensated for Lost Earnings Due to Son’s Cerebral Palsy

Catherine Kenny had big plans for her son, Shane. They live on a farm, and Shane was set to be the sole inheritor of the farm. He would oversee every task on the family’s 168 acres, which is valued at €2.3 million. When he became too old, he would sell the farm or pass it along to his children.

Unfortunately, doctors made a mistake during Shane’s birth that led to his cerebral palsy. Due to his disability, he cannot work on the farm. Catherine filed a birth trauma lawsuit on behalf of her son to reclaim all the potential wages that he could have earned running the farm. The judge found that Shane’s birth injury disqualified him from earning a living from the family’s farm.

The Kennys received €665,000 to compensate for potential lost wages. This is on top of an earlier €1 million award to compensate for his injuries and medical costs.

This lawsuit shows how one mistake during delivery can have permanent, lifelong consequences for the child and the entire family. It also shows that there are options for families devastated by birth injuries that result in conditions like cerebral palsy, Erb’s palsy or shoulder dystocia.
